Debt collection Payday loan

Complaint #1419278 submitted on 06/12/2015 relating to Kingston Mediation Services. Complaint relates to Debt collection Payday loan - Improper contact or sharing of info Talked to a third party about my debt.

Complaint was submitted via Web and sent to the company on Friday 12th June 2015.

Narrative (may be redacted).

Although the collection agency did reveal information to a third party about my debt, I could have selected several other options. This creditor whom is either XXXX XXXX attorney at law or XXXX XXXX with a return phone number of XXXX has threatened me with legal action even going as far as telling a third party that they tried to file, but could n't because they did n't know what county or state I was in. Another violation would be that they have not sent a letter of validation. I called this company and have been unable to speak to anyone as it goes straight to voice mail. The original contact from this company was on XXXX XXXX, XXXX. On XXXX XXXX, XXXX, I left message demanding a letter of verification and as of XXXX XXXX, XXXX, I still do not have it. An Internet search to verify the validity of this lawyer as a collection agent or XXXX has found an estate attorney, an adoption attorney, and a in house attorney for a different companyXXXX searches, as a company, only come up with references that this is a fraudulent company. Although I believe there maybe many XXXX XXXX as an attorney, it seems unlikely that there is not XXXX mention of him as a legitimate collection attorney. His name would come up as people would complain about his collection practices as I am doing now.

They told a third party whom they are supposedly collecting for but none of their supporting evidence applies to my situation. Although I have done business with XXXX, that is the only part of the information given to the third party that was verified. The rest of the details did not apply. Furthermore, they state they can not " find me ''. My address is part of the contract that I signed with cash net and I have lived at this address for 10+ years. They stated that they have tried to file suit against me but California rejected the suit because they did n't know what county I lived in. And they told the third party that the statue of limitations was almost up for them to collect which is blatantly untrue. California statue of limitations of written contracts is four years, if I signed the contract as they state in XXXX, XXXX, the statue of limitations would not expire until XXXX, XXXX almost a full two years from today.

I believe they have violated the fair credit collection act several times by disclosing information to, a third party, by threatening legal proceeding, and by not sending a validating letter by XXXX XXXX, XXXX. I can not give you their address as I do n't have it. They have sent no correspondence at all. I will have to verify the last time I was contacted for collection on this matter but I do know that I have no written documentation from this company.

I believe this to be a unfair practices as best and possibly outright fraud. As I stated the only part of what they revealed to the third party that was correct was that I had business dealings with cash net. The dates and amounts were incorrect and the fact that they can not find someone at their address for XXXX years is ridiculous.

Thank you for your assistance in this matter.
