Complaint was submitted via Web and sent to the company on Wednesday 20th May 2015.
I called Patenaude & Felix XXXX XXXX, on XXXX XXXX, XXXX, per your instruction. A certain lawyer answered, and said, just continue paying {$150.00} and we will just continue receiving it. We did not reach an agreement to pay specific amount monthly, because they are requiring a monthly payment of more than {$150.00}. They are accusing me that when I called in XXXX XXXX, I offered them to pay {$700.00} but I did not offer this amount because I can not afford it, I have XXXX others students loans that I am paying every month. I am under a severe financial hardship and difficulties, I am just a job trainee, and married. An evidence of this financial hardship, is already known to Patenaude & Felix XXXX XXXX, because their claim for Salary garnishment submitted to my employer was dismissed by Levying Officer of XXXX XXXX, CA, in XXXX XXXX, XXXX because I have a negative monthly balance of my salary over my expenses of ( {$900.00} ). My urgent concern is this complain, Patenaude & Felix XXXX XXXX has filed a Memorandum of Cost worth, {$4800.00}. I learned about this Memo of cost yesterday, XXXX XXXX, XXXX, it was delivered to me in person, I do not live with my parents address since, XXXX XXXX. Please help me, because this Patenaude has won an immediate default Judgment against me without my knowledge. They have succeeded in filing all kinds of Court document with the Superior Court of XXXX County, XXXX XXXX XXXX, Unlimited Civil case. These documents are Civil case, Declaration of Venue, Summons, Complaint-Contract, Cause of Action, etc. I have seen documents only because I requested copies from Superior Court of XXXX County, XXXX XXXX XXXX, through the internet ; I paid for each copy, because I needed it to support for my Claim for Exemption for Wage garnishment. I would not have known this completed case filed by Patenaude, had my employer not shown me the claim for Wage garnishment, but XXXX answered my prayer, the Levying Officer of XXXX XXXX dismissed it. We are paying this student loan that Patenaude & Felix XXXX XXXX filed a case, since year XXXX, after the forbearance period of this student loan, our payment was paid to XXXX XXXX XXXX XXXX XXXX XXXX, it was included and combined into my other student loan, that is why my other student loan became overpaid for up to 2 years. I talked to XXXX XXXX XXXX, who serviced this loan, disbursed in XXXX XXXX, XXXX. I asked XXXX why did they not informed me that they were not paying this XXXX loan, because I have XXXX separate/invidual private student loan with XXXX XXXX XXXX XXXX , XXXX My payment is specifically instructed in each direct debit from XXXX bank, so, I have all the copies of all my payment, since we religiously paid our loan, partially since XXXX. Patenaude & Felix XXXX office wording in their cases filed against me is in error. The have declared my default judgment to an amount of {$52000.00}. What should I do since, I have been paying this loan since year XXXX, but XXXX made an error by not recording it to the appropriate individual loan, and they did not inform me. XXXX used XXXX account number, so regardless of how many loan I have, only XXXX account number is assigned. Please stop Patenaude from pursuing this case, because it is in error. XXXX last recorded payment for this loan was in XXXX/XXXX/XXXX. So, in XXXX/XXXX/XXXX, XXXX declared this loan as delinquent and eventually was released back to the guarantor, XXXX XXXX XXXX XXXX , XXXX, in the amount of {$47000.00}. XXXX XXXX assigned this account to XXXX Collection agency, and then to Patenaude & Felix XXXX XXXX. We have paid this student loan since year XXXX, XXXX, XXXX, XXXX & up to the present date. Also, the California laws stated that a debtor is given 270 days for non-payment, and 335 days for partial payment. Thank you.
