Since XXXX XXXX, 2015 I have been requesting the bank to provide me a copy of my mortgage servicing file in accordance with the Real Estate Settlement Procedures Act ( Regulation X ) 1024.36 - Requests for information. I have submitted my request in writing as indicated by the regulation. The bank ignored all the requests made until the last request made on XXXX/XXXX/2015 which the bank answered on XXXX/XXXX/2015, but refusing to provide the information indicating that it is overbroad or unduly burdensome request for information. The bank is in violation of the applicable regulation since it failed to acknowledge the request for information in the time frame indicated by the regulation and the overbroad or unduly burdensome request for information response is not applicable in this case.
I have attached the letters sent to the bank requesting the file and the bank 's response.
