A few weeks ago, I noticed on my bank statement that there was a {$1200.00} withdrawal that neither my wife, nor myself had made. I checked with the bank and found out that they had paid funds out of our account as the result of a lien they received from Messerli & Kramer. Not knowing who or what Messerli & Kramer was, I contacted them via phone and electronic messaging ( web site ) to ascertain what this was about. They did not returned either message.
I asked the bank if it was standard procedure that an entity can access one 's bank accounts without notifying that individual. They stated that we should have received notices from Messerli & Kramer before the lien was filed.
I had not received any. I asked my wife if she did, and she said she had received XXXX or XXXX letters, but did not know what it was for ( was not aware of any unpaid and overdue debits ), and disposed of them, thinking it was a scam.
As I did not hear back from Messerli & Kramer, I went to their XXXX, MN location ( I was told from their XXXX XXXX XXXX, collections where handled there ). When I was there they shared what the background was pursuant to this issue.
My questions are : Is this standard procedure for a collection agency ( law firm )? How is a business like this able to access information on our bank accounts and gain access to them. Finally, I discovered when I visited their office that this was a court imposed lien. How is any court action able to happen without notification of a respondent?
