General Information Services ( GIS ) furnished a background report on me and submitted information to an employer that I applied with. The information that the reporting agency submitted is not supposed to be sent to the employer due to the fact that the state I live in has restrictions on what the agency can and can not report. On the background report, the agency submitted information that is past seven years but the state of Texas does not allow agencies to report information beyond seven years if the job pays less than {$75000.00} annually. Here is the Business and Commerce Code for the state of Texas XXXX : XXXX # XXXX Other research that I have found on this issue : XXXX The use of older cases Whereas the FCRA does not allow the use of any non-convictions older than seven years, several states go further and ban the use of any case older than seven years, even in instances when there was a conviction. XXXX states place restrictions on the reporting of ANY case information older than seven years. These types of restrictions are found in the following states : California, Colorado*, Kansas* , Maryland*, Massachusetts ( additional limitations are put on the reporting of misdemeanor offenses ), Montana, Nevada XXXX New Hampshire*, New York *, Texas *and Washington*.
