I have been with XXXX XXXX XXXX for many years and in XXXX, 2015 they were bought out by XXXX XXXX XXXX XXXX XXXX. Many things have changed since that time in the way they do business. My bank account is tied to my XXXX account which I use a great deal for small purchases ( ie : {$2.00}, XXXX etc ). On XXXX XXXX, 2015 my online banking showed XXXX XXXX charges coming in that day totaling {$630.00} so I transferred {$1000.00} over to the account more than enough to cover these charges so there would not be any overdraft fees. On XXXX XXXX, 2015 I checked my online banking only to see that I had been charged {$260.00} for XXXX overdraft fees. Apparently a check for {$550.00} came in after hours of which I had no knowledge of and they paid that before the XXXX XXXX charges that were clearly showing during the day business hours. On XXXX XXXX I went into the branch and spoke with the XXXX regarding this incident. He informed me that the bank sets people up to fail by paying highest to lowest incoming items. He also informed me that this bank currently has a lawsuit going on against them for this type of behavior. He further more informed me that several other large banks around this area have already been challenged with this very practice and been forced to change the way they do this. He told me that XXXX XXXX would not change it unless the government forced them to because it is such a large money maker for the bank. If they would have use chronological time instead of highest to lowest as an honest way of calculating overdraft charges, I would have been charge only {$38.00} instead of {$260.00} that day. I also feel that charging a {$38.00} overdraft fee for a XXXX or even a {$10.00} charge is quite over the line. I have attached copies of my online banking showing this incident. This is not the first time this has occurred for me but I am a senior cistizen livng on a fixed income and feel that I am being taken advantage of. I appreciate any help that you can assist me with in this matter.
