I have been contacted by Monterey Collections claiming I owe a debt for annual maintenance fees for a timeshare unit in XXXX. I timely responded to their initial correspondence requesting proof of debt, including signed documentation proving I am personal liable to pay this debt.
Such documents do not exist as I am not the original owner and never signed any. I bought this unit in the after market and at that time only assumed the then current year 's maintenance fees which were paid at the time of purchase.
They have not supplied me as requested any documents showing a legal responsibility to pay this ongoing fees for some undetermined time and have been reporting to the credit bureaus a debt that I do not owe, thus negatively affecting my credit.
I have disputed the debt twice with the credit bureaus and each time they have sent me as letter which is attached stating : " Please note that per the FDCPA, you had 30 days from the date you were notified by Monterey that your account had been placed with Monterey Collections, to request to dispute this debt. You were notified by Monterey Collections on XXXX/XXXX/2013 and were sent notifications at that time. You failed to request for verification within the necessary time frame. " I have responded to both of these letters that this claim is false and sent them proof in the form of a letter on their company letterhead that is dated within the 30 days of their original collection attempt letter acknowledging my receipt of my request for debt validation ( also please find attached ). Even though I did timely respond, they continue to hid behind this excuse and continue to falsely report this debt.
This company has ignored my repeated threats to file a complaints which is why I have been forced to finally do so.
