We are pre-qualified buyers, and we were informed that escrow could not close due to the condition of the property we are trying to buy. The property is considered " not functional or uninhabitable ''. We paid for an appraisal which was conducted on and informed the lender the property was not functional or uninhabitable in it 's current condition is considered unfit and unsafe. Although we were willing to do the repairs, it is a liability prior to ownership of the property. Therefore we were unable to do any repairs to the property due to liability. Although the home was sols " as is '' we did not know it was not functional and uninhabitable until after the appraisal was conducted. We had every intention of purchasing the property. We had started the process to rent our current home and organizing our packing. We also spent numerous hours first identifying the repairs needed and then gathering cost estimates for the repairs. Repairs needed due to vandalism were the following ; kitchen cabinetry, kitchen appliances, bathroom vanity, toilet and shower, repair damage to interior walls and ceiling from removal of built in terms and vandalism and paint interior, restore heating air conditioner and replace sinks and repair XXXX large tile in the master bathroom. The home is a XXXX bedroom, XXXX bathroom, with XXXX functioning bathroom, XXXX bathroom has missing vanity and toilet with shower/tub fixtures missing. Therefore, since this loan was not approved due to the condition of the property " not functional and uninhabitable '', we are requesting a full refund of the Earnest Money Funds {$42000.00}. Which we were told we could not get back by our agent, we have not spoken to Altisource, the company we transfer our funds to.
