Several years ago, approximately 2012, I took out a payday loan to help cope with a medical emergency. I had made payments for several months. I believe I repaid at least the amount borrowed or came fairly close. Regrettably due to the continued medical issue and resulting limitations on work, I was unable to continue paying the loan. Subsequently, My family in XXXX and XXXX were contacted by a collection agency regarding the debt. At XXXX point, my brother in XXXX had his dog threatened by the collection agency. My niece in XXXX was called countless times. She reports that the collection agency threatened to take her home. They cussed at me and left messages with cursing actions. To be honest, I am not sure if they actually threatened law suits because the language became quite escalated. I remember leaving with the distinct impression that they were discussing a legal liability. My bigger concern however is the threats to my family and the abusive language. In order to get them to leave my family alone, I contacted the agency and set up a payment arrangement. At this point I contacted a financial counselor who cautioned me that this loan may be of questionable legal standing in XXXX. Consequently I postponed payment and requested information from the agency regarding the debt. They denied that they had to provide any paperwork about the situation. I contacted the original creditor and they told me to contact the collection agency. I attempted to request the mailing address for the collection agency and they refused to provide the information. I called back with my financial counselor and they also refused to provide any of the information we requested. Even the company name was not disclosed. They may be XXXX XXXX or they may be collecting for XXXX XXXX. They identified themselves as Dispute Resolutions Services but would not clarify if they were a department of XXXX or a separate company. It was at this point that I reached out to the CFPB.
