SCA Collections, Inc. violated the Fair Debt Collection Practices Act [ 15 USC 1692e ] A debt collector may not use false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation : ( XXXX ) the false representation of - ( A ) the character, amount, or legal status of any debt. ( XXXX ) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.
SCA Collections, Inc. violated the Fair Debt Collection Practices Act specifically section : Validation of debts requirements [ 15 USC 1692g ].
SCA Collections, Inc. violated the North Carolina Fair Debt Collection Practices Act 58 70 110 Deceptive Representation : No collection agency shall collect or attempt to collect a debt or obtain information concerning a consumer by any fraudulent, deceptive or misleading representation. Such representations include, but are not limited to, the following : ( XXXX ) Falsely representing the character, extent, or amount of a debt against a consumer, or falsely representing the creditor 's rights or intentions.
SCA Collections , Inc. 's violations of the Fair Debt Collection Practices Act and North Carolina Debt Collection Practices Act are documented as follows : Exhibit A : SCA Collections , Inc. 's collection notice dated XXXX XXXX, XXXX addressed to me in which I received via U.S. Postal Mail. Said collection notice of SCA Collections , Inc. contains overshadowing language which violates the FDCPA. SCA Collections , Inc. 's statements contained within said collection notice such as but not limited to : " This account has been placed with this office for collection and calls for payment in full. This payment in full must be received or this account may be placed o your credit file and may impair your credit standing. If you have a valid reason for not paying in full, please contact us by telephone. Do not let your credit suffer ... Mail your payment in full to our office. " Exhibit B : My correspondence dated XXXX XXXX, XXXX delivered via Certified U.S. Postal Mail to SCA Collections, Inc.
Exhibit C : SCA Collections, Inc. 's correspondence dated XXXX XXXX, XXXX addressed to me in response to my correspondence referenced as Exhibit B. Said correspondence of SCA Collections , Inc. contained SCA Collections , Inc. 's validation of said alleged debt. However, by SCA Collections , Inc. 's on validation of said alleged debt clearly documents that the said alleged debt does not exist.
SCA Collections , Inc. 's validation of said alleged debt is of what appears to be a print-out of an account from XXXX XXXX XXXX, PA dated XXXX XXXX, XXXX. Said print-out clearly itemized a date of service of XXXX XXXX, XXXX, charge for date of services on XXXX XXXX, XXXX in the amount of {$43.00}, XXXX XXXX XXXX XXXX XXXX XXXX / Deduction on XXXX XXXX, XXXX in the amount of {$9.00}, and XXXX XXXX XXXX / Deduction on XXXX XXXX, XXXX in the amount of {$33.00}. The alleged XXXX PA alleged debt was in the amount of {$43.00} ; XXXX XXXX XXXX / Deductions in the amounts of {$9.00} + {$33.00} = {$43.00} paid in full. Therefore even after SCA Collections , Inc. did a so called validation it willfully continues to try to collect a nonexistent debt which are clear violations of the Fair Debt Collection Practices Act and North Carolina Debt Collection Practices Act.
