Complaint #1498220 submitted on 08/02/2015 relating to Byrider Franchising, LLC. Complaint relates to Consumer Loan Vehicle loan - Problems when you are unable to pay .
Complaint was submitted via Web and sent to the company on Tuesday 18th August 2015.
I purchased a vehicle from XXXX ( CNAC ) a few years ago. When I spoke with the sales rep, he ran my credit report showed me several things that were reflecting negatively on it however processed to tell me that " it would be tight '' but I would be able to meet the requirements of purchase of a vehicle from them. So, after not much of car options I selected a vehicle and proceeded to go through there paperwork process. At the time of signing my contract, which by the way, was videotaped " for closing '', I signed the signed the paperwork. I was able to make the payments on time and regularly for a little over a year then disaster struck. One of those " items '' that had appeared on my credit report that was disclosed to me when I initially purchased the vehicle came back and hit me with a garnishment. I struggled every XXXX weeks to make the payments on the car but with little income to go on, I tried to get them to help me with arrangements. The reps that assisted me were unfriendly and unwilling to work with me. It got so bad that I was finally told that this could not go on and I had to make a decision as to " whether you are going to pay for the car or turn it back in ''. I felt as though I was up against a brick wall so I made the decision to voluntarily turn the vehicle back in. Shortly after that, I received a letter from them explaining the remaining balance left that I owed on the vehicle and if I was unable to pay the balance off, the vehicle would be auctioned off and I would be responsible for the remaining balance left on the loan. Well, time went on and I finally received the letter of what the vehicle brought at the " auction '' and what my remaining balance owed would be ( approx {$7000.00} ). The sale price of the vehicle was {$10000.00} ( which for the vehicle that I purchase was well above the actual book value of the car ). After financing and all the fees were added the total amt of the vehicle purchase was {$16000.00}. Since XXXX 2011, the financing company of XXXX XXXX ( CNAC ) had issued a warrant in debt against me, turned my account over to an attorney who has been garnishing my wages ever since. My issue with all of this, since the very beginning of dealing with this company, it seems that they set up consumer 's for a fall if you are unable to complete your contract with them. They knew there were items on my credit report that could hurt me yet they still sold me a vehicle. They were unwilling to work with me when I attempted to continue to honor the contract and then when I did what they told me to do ( turn the vehicle in ) they proceeded to garnish my wages to the point of causing me to loose more money than the car was worth. It is unfair treatment to have to pay for a vehicle that you do not have anymore to the tune of astronomical amounts of money. It seems as though I will never get this vehicle paid off and can not get out from under this company 's deceptive business practices. This company goes on record to say that they can help when others can not, however they do not help, they prey on people with poor credit and charge extremely high amount of money ( such as payday cash loans and title loan businesses ) for low value vehicles to take advantage of the consumer 's bad credit.
